It’s still and scam and still fraud. It was clearly perpetrated with the intent to swindle people.

Scams are generally aimed at the “less bright” of the populace, you are saying that it is ok to take advantage of said people?

Or maybe these people are not “simple” at all, maybe they just believe in trust, or use to.

I think it’s pretty obvious if the people knew it was a picture they would not have offered $300 for it. I also think it’s clear the ad was phrased intently to deceive and mislead. The person who sold the photo obviously understood the expectations of the buyer (ie. they thought it was a machine), and would not have valued the photo at anywhere near the “selling” price, anymore than the buyer would.

That, my friend, is fraud. Anything else is cynical semantics.

I’d have to say that this case is definately a case of fraud. It was worded as such that people would be fooled in to believing that it was a console.

As for the selling of the X-Box box, it plainly said in the description that “this is only the box, not the console itself”. Although you could probably get a refund by going though the courts, by definition, its not really fraud (he stated what it was in detail). Also, in the box case, the guy bid more than you could get it retail (about 350 compared to 300 in a shop). Shows even more what an idiot he was.
